These Terms of Service ("Terms") govern your use of the Paws & Pixels website (pawsandpixels.co) and the photography, photo restoration, digitization, and related services ("Services") provided by Emily Byers Digital Media ("we," "us," or "our"), based in Kennewick, WA. By using our website or booking our Services, you agree to these Terms.
Our Services
We provide pet photography, real estate photography, photo restoration, photo and media digitization (including video and audio transfer), and related memory preservation services. We serve the Tri-Cities area (Kennewick, Richland, Pasco, West Richland) in person, and accept mail-in orders from clients nationwide.
Quotes, Pricing & Payment
Pricing depends on the scope of your project and is confirmed by quote before work begins. Payment is processed securely through Stripe. Deposits, refunds, and cancellation terms (where applicable) are specified per quote or booking confirmation at the time of your order; please refer to your individual quote for the terms that apply to your project.
Ownership of Your Photos
You retain ownership of the original photos, videos, and media you send us for restoration or digitization, as well as the resulting restored or digitized files and any new photography we create for you. We do not use your photos for our portfolio, marketing, or any other purpose without your permission.
Client Portal
Our client portal lets you track orders, view quotes, and manage your account. You are responsible for keeping your login credentials confidential and for all activity under your account.
Care of Physical Materials
We take great care with any physical photos, negatives, slides, tapes, or other media you send us for digitization or restoration. While we handle all materials with care, we recommend keeping your own copies or backups where possible, as we cannot be liable for loss or damage from causes outside our reasonable control (such as shipping loss or pre-existing material degradation).
Limitation of Liability
To the fullest extent permitted by law, our total liability arising from or related to the Services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Changes to These Terms
We may update these Terms from time to time. Continued use of our website or Services after changes are posted means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Washington.
